Chapter 5 - The Preliminary Hearing

Three weeks later, the municipal courthouse was packed with local reporters and tight-lipped family members.
Vanessa sat at the defense table wearing an orange jumpsuit, her hands cuffed at the waist. Gone was the immaculate, polished woman who looked down on everyone. Her hair was pulled back into a messy ponytail, her face pale and drawn. Next to her sat my parents, dressed in dark suits, looking like stoic martyrs.
When I walked into the courtroom holding Marcus’s arm, my mother glared at me with pure venom. I kept my head high, wearing a crisp black blazer, my eyes fixed straight ahead.
, The judge, an imposing woman named Hon. Evelyn Brooks, knocked her gavel to bring the room to order.
"We are here for the preliminary hearing in the case of the State v. Vanessa Vance," Judge Brooks announced. "Charges include Felony Aggravated Assault with a Deadly Weapon, Child Endangerment, and Tampering with Physical Evidence."
Vanessa's attorney, Pendelton, stood up confidently. "Your Honor, we request an immediate dismissal of all charges or, at minimum, a reduction to misdemeanor negligence. My client is a respected teacher and mother. This was a chaotic domestic accident caused by a cluttered kitchen and an unmonitored child."
"An unmonitored child?" Deputy District Attorney Sarah Jenkins stood up, holding a metal briefcase. "Your Honor, the prosecution would like to submit State's Exhibit A: The forensic report of the kitchen layout, along with Exhibit B: The text message sent by the defendant's mother, Eleanor Vance, to the victim's mother seconds before the incident."
Jenkins played the recorded audio of my mother's voice reading the text aloud, followed by the testimony of the forensic expert who proved the trajectory of the cast-iron pan could only have occurred through an intentional, overhead throwing motion.
"Furthermore," DA Jenkins continued, "we have the sworn deposition of the responding emergency medical technicians and the pediatric surgeon. The angle of the severe thermal burns and bone fracture on four-year-old Emma’s cheek confirms a direct, high-impact strike while the child was sitting motionless in a chair."
Pendelton fidgeted with his papers, visibly thrown off by the airtight forensic evidence. "Your Honor, even if there was a dispute, my client has no prior criminal record—"
"Your Honor," DA Jenkins interrupted smoothly, "we wish to call our next preliminary witness: Child Protective Services Officer Denise Miller."
Denise took the stand, placing her hand on the Bible and taking the oath.
"Officer Miller," Jenkins asked. "During your investigation into the family background, did you conduct an interview with six-year-old Lily Vance, the defendant's daughter?"
At the mention of Lily's name, Vanessa jerked forward in her seat, her handcuffs rattling loudly. "Leave my daughter out of this!"
"Order in the court!" Judge Brooks banged her gavel sharply. "Sit down, Ms. Vance!"
Denise looked directly at the judge. "Yes, I interviewed Lily in the presence of a child psychologist. When asked about what happened that morning, Lily stated—and I quote: 'Mommy got mad because Emma sat in my chair. Mommy said nobody touches our things, grabbed the big hot black pan, and threw it at Emma’s head. Then grandmom told me to shush and clean up the juice.'"
A collective gasp echoed through the courtroom.
My mother's face went ghastly white. My father put his head in his hands.
Vanessa slammed her hands on the table, her composure completely shattering. "She's lying! You brainwashed my daughter! You stupid bitch!"
"Order! Security, restrain the defendant!" Judge Brooks shouted over the rising commotion.
Vanessa writhed against the bailiffs, screaming obscenities at me, her eyes wild and bloodshot. "You ruined my family, Rachel! You ruined everything! You were always a useless, ungrateful leech!"
I stood motionless, looking at my sister throwing a frantic, psychotic temper tantrum in front of a judge, three reporters, and a room full of jurors. The illusion was dead. Her true nature was exposed for the entire world to see.

Judge Brooks struck her gavel three times with thunderous force.
"Bound over for trial!" the judge declared, her voice echoing with utter disgust. "Bail is revoked. Defendant will remain in custody pending trial. And I am ordering an immediate emergency protection order barring all contact between the defendant, her parents, and the victim's family!"
