Chapter 4 - The Legal Counter-Offensive
The next morning, my legal counsel—a sharp, no-nonsense family law specialist named Licenciada Marcela Garza—formally filed the petition for divorce and annulment at the civil courthouse in downtown Guadalajara.
The grounds listed were comprehensive: psychological abuse, fraudulent inducement to marriage, financial coercion, and documented verbal harassment. Furthermore, my father’s legal team filed a supplementary motion requesting a restraining order against Brandon, his parents, and any associates attempting to contact me or my family.
I sat in Licenciada Garza’s sunlit office, reviewing the paperwork. The walls were lined with heavy law books, and the smell of fresh coffee mixed with the crisp scent of paper documents.
"Your husband's family is attempting a frantic counter-strategy," Licenciada Garza said, sliding a certified document across her mahogany desk. "They’ve hired a high-priced civil litigator who is trying to claim that the wedding funds constitute a 'shared marital asset' regardless of whose name is on the account, because the money was gifted during the wedding ceremony."
I picked up the document, scanning the dense legal jargon with a calm eye. "Can they prove the money came from their side?"
"Partially," Garza explained, leaning back in her leather chair. "They did contribute four hundred and fifty thousand dollars initially. However, under Mexican civil law, gifts given prior to or during a marriage ceremony intended for the mutual establishment of a household can be contested, unless there is clear evidence of bad faith, immediate abandonment due to abuse, or separate private trusts established prior to legal cohabitation."
She smiled, tapping a finger on a separate folder marked Confidential Evidence. "Fortunately, your father insisted on signing an ironclad prenuptial financial protection clause two weeks before the wedding, specifying that any funds deposited into individual accounts remain the exclusive property of the recipient unless explicitly commuted by mutual notarized consent. Your husband signed it. He was too busy boasting about his real estate deals to read page seven."
A genuine laugh escaped my lips. "He never reads anything unless it has dollar signs attached to it."
"Exactly," Garza nodded. "And that arrogance is going to cost him everything. Furthermore, we have the audio recording your mother took when Brandon's father called her yesterday afternoon threatening to ruin your reputation if you didn't hand over the keys to the account. That constitutes attempted extortion and coercion under civil and criminal codes."

"I want to press every charge available," I said firmly, looking her straight in the eye. "I am not looking for a settlement, Marcela. I want a complete legal separation, full asset protection, and a public refutation of any claims they’ve made against my family."
"Consider it done," Garza said. "Prepare yourself, though. People like the Whitmores don't go down quietly. When cornered, narcissists throw tantrums. And Brandon’s tantrum is going to be spectacular."
